All other names, logos, product and service names, designs, and slogans on this Website are the trademarks of their respective owners. 

 SECTION 14 - PRODUCT WARRANTIES, DISCLAIMERS, AND LIMITATION OF LIABILITY 14.1 Express Warranty Scope. The only express warranty MyHerbalist, Inc. provides with respect to any product purchased through this Website (each, a “Product”) is that, at the time of shipment, the Product will materially conform to the description set forth on the Product label. To assert a claim that a Product fails to conform to the express warranty in Section 14.1, you must notify us in writing at support@theremedistapothecary.com within thirty (30) days after you discover, or reasonably should have discovered, the alleged non-conformity, and in any event within the Product’s printed expiration date. Your notice must include your order number, the lot number printed on the Product, photographs of the Product as received, and a description of the alleged defect. The procedures for returning allegedly defective Product, our inspection process, and the available remedy (replacement, store credit, or refund) are governed by our Shipping & Returns Policy, which is incorporated into these Terms by reference. The remedies set forth in the Shipping & Returns Policy are your sole and exclusive remedies for any Product non-conformity, except for any remedy that cannot be excluded or limited under applicable law.

Disputes arising from these terms of use and your use of the website shall be resolved by binding arbitration as provided below, by agreeing to binding arbitration, you are hereby waving the right to bring disputes to a court, including the right to trial by jury. If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trials. We also both agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights. Shipping & Returns Policy




Our Promise to you

These Shipping and Returns Terms (the “Terms”) are entered into between you and MyHerbalist Inc., a Delaware corporation with principal place of business at 103 Foulk Road, Suite 202, Wilmington, Delaware 19803, United States of America (hereinafter referred to as “The Remedist”, “MyHerbalist”, “we”, “us” or “our”), the operator of the website www.theremedistapothecary.com (the “Website”) and the seller of the products offered through it.

At The Remedist, we take great care in how we source, formulate and extract every remedy. We strive to make our products so that you absolutely love them. If you are not fully satisfied with your purchase, our customer satisfaction policy is described below.

Refunds

If you are not satisfied with our products, you may request a refund under the following conditions:

-          To be eligible for a refund, the refund request must be made within 60 days of receiving your order.

-          Orders under $100: You will receive a full refund, excluding shipping & handling costs.

-          Orders over $100: We will issue a refund minus a 15% restocking/processing fee based on the total order value.

-          Shipping & handling costs are non-refundable unless the item arrives damaged or incorrect. Please see the dedicated sections below.

-          This satisfaction policy applies to both opened and unopened products. You do not need to return the product.

For refund requests or assistance, please contact us at support@theremedistapothecary.com with the subject “Refund request”, so it can be properly addressed.

Original shipping and handling charges are non-refundable. This policy is offered as a goodwill customer accommodation and is not a warranty regarding the products. The warranties applicable to the products, and your remedies for any product defect or non-conformity, are set forth in Section 14 of our Terms of Service and in the “What if I think my product is defective or doesn’t match its label?” section below.

Please note: this satisfaction policy applies only to products purchased through our official website and is available only to the original purchaser; refunds are issued to the original payment method. Gift recipients should ask the original purchaser to initiate any satisfaction-based refund or return request. Any claim regarding a product defect, non-conformity, or product safety may be raised by any user regardless of who purchased the product, and is governed by Section 14 of our Terms of Service and by applicable law.

When will I receive my refund?

Once your refund request is processed, your refund will be issued to your original payment method within 5–10 business days.

What if my order arrives damaged in transit, or I received the wrong item?

This section covers shipping or packaging damage that occurred in transit, and fulfillment errors (such as receiving the wrong item). For concerns about the product itself (such as suspected defects or non-conformity with the label), please see the next section below. If your order arrives with transit damage or you received the wrong item due to a fulfillment error, please contact us within 14 days of delivery at support@theremedistapothecary.com with your order number.

For full acceptance of a damaged goods claim, we need photo evidence and adequate proof of damage provided by the customer. This allows us to submit the claim to the courier. Please include photos of all sides of the box the package was shipped in, the inner packaging, as well as the damaged item itself. Please save the original packaging in the event that a claim is filed.

We will only replace clearly damaged items in your order. We will not replace non-damaged items in your order.

 

What if I think my product is defective or doesn’t match its label?

If you believe a product you received is defective or does not conform to the description on its label - for example, if you have concerns about its potency, ingredients, appearance, smell, or condition that go beyond your subjective satisfaction with the product - please contact us at support@theremedistapothecary.com within thirty (30) days of discovering the issue, and in any event before the printed Best By date on the product. Please include in your email:

             your order number;

             the lot or batch number printed on the product packaging;

             a description of the issue, including how and when you noticed it; and

             photographs of the product, the label, and the lot number. 

Please do not ship the product back to us before contacting us. Once we have reviewed your claim, if we confirm the product is defective or non-conforming, we will arrange and pay for return shipping and, at our election, provide a replacement, store credit, or refund. Where appropriate, we may ask you to retain or safely dispose of the product rather than return it. This is our sole process for handling defect and non-conformity claims, and the remedies described above are your sole and exclusive remedies for any defect or non-conformity in the products, as further set out in Section 14 of our Terms of Service. My package never arrived, what do I do?

Please first check the status of your shipment using the tracking number provided in your delivery confirmation email. If the tracking information indicates the package was lost in transit and never delivered, please email us at support@theremedistapothecary.com with your order number and we will arrange, at our election, a replacement shipment or a full refund at no additional cost to you. If the tracking information indicates the package was delivered but you are unable to locate it, please contact us within 7 days of the marked delivery date so we can work with the carrier to investigate. Post-delivery loss or theft is generally outside our responsibility, but we may, at our discretion, offer a replacement or partial refund as a customer accommodation depending on the circumstances. For valuable orders, we recommend selecting signature confirmation at checkout. 

 

Order Processing & Delivery Times

Orders are typically processed within 1–3 business days from when the order is placed, Monday through Friday, excluding public holidays. During peak holiday season, you can expect this to go up to 5-7 business days. Once shipped, standard delivery within the continental United States typically takes 3–7 business days to deliver from our fulfillment center, with an additional up to 7 days required to reach non-contiguous states and territories such as Hawaii or Alaska.

You will receive a confirmation email with tracking information as soon as your order has been dispatched.

Free Shipping when you order $100 or more

We offer free standard shipping on all orders over $100, applied automatically at checkout. Free shipping is only valid on ground shipping within the continental United States.

Where We Ship

We currently ship within the United States only. We do not ship internationally at this time.

Order Changes & Cancellations

Once an order is placed, it begins processing quickly to ensure timely delivery. Because of this, we are not able to guarantee changes or cancellations after an order has been submitted. This includes updates to shipping addresses, so we recommend reviewing your details carefully before completing checkout.

In the event of any conflict between this Policy and the warranty and remedies provisions of Section 14 of our Terms of Service with respect to a product defect or non-conformity claim, the Terms of Service control.
